The objective of the assignment is for one international expert (company or individual) to, in line with MRC-GIZ Cooperation Programme Objectives and key MRC documents (Strategic Plan, 2018 Annual Work Plan) support GIZ within the MRC Secretariat in terms of guidance for and review of dam safety assessments in a transboundary/cascade context, specifically relating to.
1) Update of the Design Guidance for Proposed Mainstream (and Tributary) Dams on the Lower Mekong Basin
2) Review of to be submitted documents under
(i) a 4th prior consultation process (PNPCA);
(ii) regarding the final design of the Xayaburi Hydropower Project; and
(iii) under an implementation of a Joint Action Plan for the Pak Beng Hydropower Project
1) An application is only possible using the required documents provided by the contracting authority (compare sec. I.3) of this notice ‘communication’). The documents must be completed in English. Formless applications will not be considered. The documents must be submitted together in triplicate, on time and locked.
2) Consortia must already apply as consortia. The subsequent formation of a consortium is not possible. Consortia have to provide the required information for every member. They have to mark this information accordingly, designate a lead partner and authorise this member to represent the consortium and receive payments for all members in discharge of the liability for the contracting authority. A formal agreement to this effect must be signed by each member of the consortium and attached to the application.

According to section 160, paragraph 3 sentence 1 Act against Restraint of Competition (Competition Act —GWB), application for the review proceeding is inadmissible if:
1) The applicant has identified the claimed infringement of the contract award regulations before submitting the application for the review proceeding and has not submitted a complaint to the contracting entity within a period of 10 calendar days; the expiry of the period pursuant to section 134, paragraph 2 GWB remains unaffected.
2) Complaints of infringements of contract award regulations that are evident in the notice are not submitted to the contracting entity at the latest by the expiry of the deadline for the application specified in the notice or by the deadline for the submission of bids.
3) Complaints of infringements of contract award regulations that 1st become evident in the tender documents are not submitted to the contracting entity at the latest by the expiry of the deadline for application or for the submission of bids.
4) More than 15 calendar days have expired since receipt of the notification from the contracting entity that it is unwilling to redress the complaint.
